1. Definitions

  • "Agreement" means these Terms & Conditions, together with our Privacy Policy and Cookie Policy.
  • "We / Us / Our" refers to Warisan Legal, a legal services firm operating at Level 14, Menara Worldwide, Jalan Bukit Bintang, 55100 Kuala Lumpur, Malaysia.
  • "You / User" refers to any person visiting our website or engaging our legal services.
  • "Services" refers to will drafting and review, probate and estate administration, estate planning, and any related legal work provided by Warisan Legal.
  • "Website" refers to the website operated at warisanw.live.
  • "Content" refers to all text, images, documents, and materials on the Website.

2. Acceptance of Terms

By accessing the Website or contacting Warisan Legal to enquire about or engage our Services, you confirm that you are aged 18 or over, have the legal capacity to enter into a binding agreement, and accept these Terms in full. If you are acting on behalf of another person or an estate, you confirm that you have the authority to do so. Use of the Website or submission of an enquiry constitutes acceptance of these Terms.

3. Description of Services

Warisan Legal provides legal services in the following areas:

  • Will drafting and review — preparation or review of a will under Malaysian law
  • Probate and estate administration — obtaining grants of probate or letters of administration and administering an estate
  • Estate planning and trusts — advice on arranging an estate, including testamentary and inter vivos trust structures

Services are available to clients in Peninsular Malaysia. Specific availability may be subject to the nature of the matter. We do not offer services in areas outside our practice areas and will advise you if a matter falls outside our scope.

4. Engagement of Services

A formal solicitor-client relationship arises only upon execution of a written engagement letter and, where applicable, payment of an agreed deposit or initial fee. Prior correspondence or consultations do not constitute a formal engagement. Information shared before formal engagement is held in confidence but may not be acted upon without an instruction.

Fees are stated before any chargeable work begins. Written cost estimates are provided and agreed in advance. Changes to scope are discussed and agreed before additional work is undertaken.

5. User Responsibilities

When using our Website or engaging our Services, you agree to:

  • Inform us promptly of any changes to information already provided

8. Payment Terms

Fee estimates are provided before work commences. Invoices are issued in Malaysian Ringgit (RM) and are payable within fourteen calendar days of the invoice date unless otherwise agreed in writing. Outstanding fees may attract interest at the rate applicable under Malaysian law. We reserve the right to suspend or terminate services for materially overdue accounts.

9. Confidentiality

Solicitor-client privilege applies to all communications made in the context of a legal engagement. We will not disclose information about your matter to third parties without your consent, except where required by law, court order, or our professional obligations under the Legal Profession Act 1976 (Malaysia).

10. Disclaimers

The Website and its content are provided "as is". We do not provide any representation or assurance regarding the outcome of any legal matter. Legal outcomes depend on facts, applicable law, court decisions, and other factors beyond our control. Nothing in these Terms or on the Website constitutes a guarantee of any specific result.

11. Limitation of Liability

To the extent permitted by Malaysian law, our liability for any loss arising from use of the Website is limited to the amount of fees paid to us in the preceding twelve months. We are not liable for indirect, consequential, or incidental losses arising from use of the Website. Our liability in respect of legal services is governed by our engagement letter and applicable professional standards.

12. Termination

Either party may terminate a legal engagement with reasonable notice, subject to any terms in the engagement letter. Upon termination, all outstanding fees for work completed become due. We will provide a copy of your file upon request and payment of any outstanding balance. We reserve the right to cease providing services in the event of a material breach of these Terms or applicable law.

13. Dispute Resolution

In the event of a dispute arising from our Services, we encourage you to contact us in the first instance at [email protected]. We aim to resolve concerns promptly and informally. If a dispute cannot be resolved informally, it shall be referred to the Bar Council of Malaysia's complaint mechanism or, if appropriate, to mediation or the courts of Malaysia.

14. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes that cannot be resolved informally are subject to the exclusive jurisdiction of the courts of Malaysia.

15. Changes to These Terms

We may update these Terms from time to time. The revised version will be published on this page with an updated "Last Updated" date. Continued use of our Website after a change is made constitutes acceptance of the updated Terms. Material changes affecting active client engagements will be notified in writing.
